加拿大6月1日后留學(xué)生新政獨(dú)家解析

? ? ? ?首先，到加拿大留學(xué)的學(xué)生，除了在加拿大駐中國使館獲得的簽證VISA之外，到了加拿大入關(guān)時(shí)，還需要憑借VISA和加拿大學(xué)校的入學(xué)通知書獲得“Study Permit”， 即在加拿大學(xué)習(xí)所必需持有的”學(xué)習(xí)許可“，學(xué)習(xí)許可上面會(huì)標(biāo)明學(xué)生學(xué)習(xí)所在的地區(qū)和學(xué)校，留學(xué)加拿大的學(xué)生，簽證和學(xué)習(xí)許可，兩者缺一不可，所謂”加拿大留學(xué)新政“的”新“字其實(shí)更多的是對(duì)于”學(xué)習(xí)許可“的規(guī)定做出了更嚴(yán)格的要求。

? ? ? ?（一）、只有認(rèn)證教育機(jī)構(gòu)可以招生

? ? ? ?To apply for a study permit on or after June 1, 2014, you will need to have a letter of acceptance from a designated learning institution.

? ? ? ?6月1號(hào)之后，申請(qǐng)學(xué)簽必須需要認(rèn)證學(xué)校的錄取通知，非認(rèn)證機(jī)構(gòu)的學(xué)生將不能申請(qǐng)學(xué)簽。

? ? ? ?A list of designated learning institutions at the post-secondary level will be available on the CIC website by June 1, 2014

? ? ? ?加拿大移民局已公布認(rèn)證學(xué)校名單。

? ? ? ?（二）、非認(rèn)證學(xué)校的在讀生暫時(shí)不受影響，擁有三年暫緩期。

? ? ? ?If you were issued a study permit before June 1 and are studying at an institution that is not designated for international students: you will be able to pursue the program of?study that you are enrolled in for the duration of your current permit; and you will be able to renew your study permit in order to complete your program, but not beyond June 1, 2017. ? ? 如果你獲得學(xué)簽是在6月1號(hào)之前，移民局還是允許你在非認(rèn)證機(jī)構(gòu)上學(xué)直至2017年6月1日。

? ? ? ?（三）、轉(zhuǎn)學(xué)必須主動(dòng)通知移民局，并且只能在認(rèn)證教育機(jī)構(gòu)里面轉(zhuǎn)。

? ? ? ?You must notify CIC via your MyCIC account when you are transferring from one designated learning institution to another, even if it is at the same level of study.

? ? ? ?If you are thinking about changing your institution or your program, you need to ensure that you continue to meet the conditions of your study permit, as well as the conditions that allow you to work, should you wish to work during your studies.?

? ? ? ?6月1號(hào)之后，你如果轉(zhuǎn)學(xué)，只能在認(rèn)證機(jī)構(gòu)里面轉(zhuǎn)，而且你有責(zé)任通知移民局的轉(zhuǎn)學(xué)情況。

? ? ? ?As of June 1, 2014, all study permit holders in Canada will need to actively pursue studies. This means that: if you hold a study permit, you must remain enrolled and make reasonable and timely progress towards completing your program failing to do so could lead to your removal from Canada.?

? ? ? ?Your educational institution will report to CIC on your continued enrolment and academic status. You may also be asked by an immigration officer to provide evidence of your continued enrolment and academic status.?

? ? ? ?新政后移民局將會(huì)通過認(rèn)證教育機(jī)構(gòu)的匯報(bào)來掌握學(xué)生的實(shí)際學(xué)習(xí)狀況，所以如果你入境不讀書注冊或者轉(zhuǎn)學(xué)不通知移民局的話，你很有可能會(huì)收到removal order 被遣送離境。

? ? ? ?（四）關(guān)于轉(zhuǎn)學(xué)具體結(jié)合幾種實(shí)際情況重點(diǎn)說明一下：

? ? ? ?1、學(xué)生就是手上有兩個(gè)offer（入學(xué)通知書），用第一個(gè)offer申請(qǐng)的簽證，但是想去第二個(gè)學(xué)校。

? ? ? ?具體出現(xiàn)這種情況的原因，可能是心儀學(xué)校的offer來的比較晚，來不及申請(qǐng)簽證，所以先用一個(gè)offer提前遞簽。

? ? ? ?這種情況不在少數(shù)，后有個(gè)簡單的方法來通知移民局：那就是在機(jī)場入境獲得Study Permit時(shí)，跟移民的官員說實(shí)話，解釋你真正想去讀的學(xué)校是后來那所，一般情況下邊境署的官員會(huì)給你按照后來的offer出study permit。如果這樣，你在CIC系統(tǒng)里面自動(dòng)就更新了學(xué)校信息，Study Permit也會(huì)注明新的學(xué)校。

? ? ? ?這種做法可能會(huì)有一定的風(fēng)險(xiǎn)，到時(shí)邊境署的官員可能會(huì)詢問你這樣做的理由，事先要準(zhǔn)備好，不要讓他們懷疑你入境讀書的動(dòng)機(jī)真實(shí)性， 可以令人放心的是，筆者從事加拿大留學(xué)16年，到目前為止，還沒有遇到一例因此而被遣送回國的學(xué)生呢！

? ? ? ?2、持有老學(xué)簽（Study Permit）的，去年或者今年6月之前入境已經(jīng)更換了學(xué)校， 卻沒有更換過學(xué)簽-學(xué)習(xí)許可上標(biāo)明的還是舊學(xué)校

? ? ? ?這種情況，6月1號(hào)之后最好通知移民局。為什么說“最好”呢？理論上原來只要是高等教育機(jī)構(gòu)（大學(xué)或?qū)W院）之間的轉(zhuǎn)學(xué)就無需更換學(xué)簽或者通知移民局，另外學(xué)校也不會(huì)去主動(dòng)向移民局報(bào)告學(xué)生注冊出勤狀況。但是新政后，所有認(rèn)證學(xué)校都必須報(bào)告，這里面針對(duì)第一種情況就會(huì)有潛在的問題出現(xiàn)：

? ? ? ?你原來轉(zhuǎn)學(xué)的學(xué)校還是否存有你的檔案？如果學(xué)校還存有你的檔案，那它就會(huì)向移民局報(bào)告你缺勤或者沒有注冊，這時(shí)候你如果不主動(dòng)向移民局報(bào)告你的轉(zhuǎn)學(xué)行蹤，很可能就會(huì)出現(xiàn)問題。如果之前的學(xué)校已經(jīng)刪除了你的檔案，那它就不會(huì)報(bào)告你的行蹤了。

? ? ? ?所以建議是，為了避免無謂的麻煩，最好6月1號(hào)之后自己主動(dòng)申報(bào)給移民局。

? ? ? ?3、持有老學(xué)簽，轉(zhuǎn)到非認(rèn)證學(xué)校學(xué)習(xí)的

? ? ? ?情況類似第2種，如果你中間并沒有更換過學(xué)簽，你最好通知移民局，讓他們知道你實(shí)際在學(xué)習(xí)，哪怕是在非認(rèn)證學(xué)校學(xué)習(xí)。

? ? ? ?這種情況下的老學(xué)簽仍然有效，并可以申請(qǐng)延期，但只能到2017年6月1號(hào)。

? ? ? ?（五）、學(xué)簽將具有工簽屬性

? ? ? ?On June 1, 2014, if you hold a study permit but you have not yet applied for an Off-Campus Work Permit, you are authorized to work off campus without a work permit as long as you meet the eligibility requirements for working off campus.?

? ? ? ?If you apply for a study permit on or after June 1, 2014, the conditions relating to your eligibility to work off-campus will be written on your study permit.

? ? ? ?6月1號(hào)之后，持有有效學(xué)簽可以合法打工。平時(shí)每周20小時(shí)，暑假假期可以全職。

? ? ? ?對(duì)于6月1號(hào)之前頒發(fā)的老學(xué)簽，雖然頒發(fā)時(shí)上面沒有寫著可以打工的條件，但是新政后等同于新學(xué)簽，可以直接憑老學(xué)簽去service Canada申請(qǐng)SIN，合法打工。

? ? ? ?對(duì)于6月1號(hào)之后頒發(fā)的新學(xué)簽，上面將會(huì)注明你可以合法打工的條件。

? ? ? ?（六）、對(duì)于COOP實(shí)習(xí)工簽

? ? ? ?New rules may affect your eligibility to work as part of a co-op or internship program： Starting June 1, 2014, you will be able to work as part of a co-op or internship program only if the work is an essential part of an academic, vocational or professional training program offered by a designated learning institution. To work as part of a co-op/internship program, you will need a co-op work permit that is separate from your study permit. If you are studying English or French as a second language （ESL/FSL）， or participating in general interest or preparatory courses, you will not be eligible to work during your studies, unless you become eligible to apply for a work permit with a positive Labor Market Opinion from Employment and Social Development Canada.

? ? ? ?對(duì)于COOP實(shí)習(xí)工簽，新政后還是需要申請(qǐng)。對(duì)于ESL/FSL的學(xué)生，將不允許打工，學(xué)簽上面會(huì)注明此條件
